Representatives are aware of the Conn fraud case and the subsequent redeterminations; nonetheless, Conn is not the end of the problem. Similar fraud redetermination processes have been filed by the SSA in several states and Puerto Rico, impacting hundreds of Social Security recipients. In New York, Puerto Rico, Florida, and Illinois, there are current fraud redetermination processes, as well as ancillary difficulties with evidence exclusion in non-fraud redetermination cases. A class action complaint is also underway in Puerto Rico, in addition to the Hicks case. This workshop will offer representatives with important resources and practice suggestions while discussing the growing prevalence of such redeterminations and related issues, as well as major developments in ongoing litigation.
Heather Freeman defends Social Security disability claimants/plaintiffs in federal court appeals in a variety of locations, as well as at the Social Security Administration’s Appeals Council. Ms. Freeman also consults and writes for attorneys and claimants’ representatives all around the country.

Garg, Arpit

Arpit K. Garg, an attorney, oversaw the briefing and argued Hicks v. Commissioner, as well as a previous exhaustion appeal, Martin v. Colvin, before the Sixth Circuit. He is a Counsel in Wilmer Cutler Pickering Hale and Dorr LLP’s Appellate & Supreme Court Dispute Group, which has been providing pro bono help with the Conn litigation since November 2015. He clerked for Ninth Circuit Judge Reinhardt, Southern District of New York Judge Cote, and Supreme Court Justices Souter and Breyer.

Goss, John

Attorney John Goss has been practicing law since 1977, and his firm, Goss & Fentress, was founded in 1982. His practice focuses on Social Security Disability Law, and he has successfully defended hundreds of disability claims throughout the course of his career. Mr. Goss replied to NOSSCR’s 2015 appeal for attorneys to defend disability claimants undergoing redetermination in Eastern Kentucky and West Virginia. He has represented approximately 50 of these claims to far and has been involved in training volunteer attorneys in Kentucky. He is one of six 2016 ABA Pro Bono Award honorees. Mr. Goss received his J.D. from the Marshall-Wythe School of Law at the College of William and Mary.

Patitucci, John

Attorney John Patitucci earned his bachelor’s degree in political science from Providence College in 2007. He returned to New York after graduation to attend Brooklyn Law School, where he also graduated with honors. In 2017, John was admitted to the New York Bar. He is also admitted to practice in Massachusetts and the Eastern District of New York of the United States District Court. John has been a member of the New York State Bar Association for approximately 7 years and practices Social Security Disability litigation. Throughout his professional career, John has demonstrated his commitment to supporting people in our community who are less fortunate by volunteering at Nassau Suffolk Law Services and Greater Boston Legal Services. The Suffolk County Pro Bono Foundation, Nassau Suffolk Law Services, and the Suffolk County Bar Association honored John with a Certificate of Recognition for his time, efforts, knowledge, and excellent commitment to the Suffolk Pro Bono Project.
